Terms and Conditions

The present Contract stands for the agreement between Elysian Villas and the Client (the person making the booking). It replaces all prior understandings (oral or written) covering the subject matter and can be changed only in writing signed by both parties. No firm booking/contract is made until both the signed Contract and the deposit or full payment have been processed and received by Elysian Villas. The Client has no legal right for special request to be fulfilled unless it has been confirmed in writing by Elysian Villas. However if the Client has any such requests, we can only accept them on a non-binding basis.

Payment

The Client acknowledges being a member of the traveling party and shall pay a partially non-refundable deposit of 40% of the Total Rental Amount within 48 hours of the Confirmation e-mail. The remaining balance is due eight weeks before the rental period. If booking within eight weeks of the rental date, the entire contract price shall be paid within 48 hours of the Confirmation e-mail. No credit cards or personal checks or cash on arrival are accepted. All payments by international bank drafts to the Elysian Villas corporate accounts or Owners’ account supplied. If any payment is not made within the times set forth herein, Elysian Villas may treat the contract as cancelled. Payment all made in Euro, amounts should be received NET of bank charges (please instruct your bank to do so). Proof of payment is the day the wire is deposited to Elysian Villas bank accounts and NOT the day money are wired from guest bank accounts. An official Invoice/Receipt will be issued with the last payment.

Client cancellation charges

All cancellations are subject to penalties based on the date we receive Client’s written notice of cancellation. These charges are immediately payable by the Client:

• 56 to 30 days prior to the rental period: 50% of the full rental price;

• 29 to 10 days prior to the rental period: 80% of the full rental price;

• 9 or less days prior to the rental period: 100% of the full rental price.

Changes to the rental date are a complete cancellation.

Modification or cancellation by Owner or Elysian Villas

Elysian Villas reserves the right to modify or cancel the Contract at any time in any case where it is necessary to do so as a result of a force majeure (death, illness, war, conflict, social unrest, strikes, power shortages, unforeseen events, etc and their consequences thereof), or any other occurrence outside the control of Elysian Villas. In the event of any change or cancellation by the property owner, Elysian Villas shall inform the client promptly and shall endeavor to offer the Client substitute properties. Should the Client accept the substitute property of their choice the Client will pay or receive the difference in rate for the new property. In the event of changes or complete cancellation, Elysian Villas liability will be limited to the refund of 100% of the amount paid. In no event will Elysian Villas be responsible for any consequential or incidental damages, including travel expense, alternative lodging, or other expense.

Number of Occupants

Including the Client, the number of clients lodging at any one time cannot exceed the total party size specified in the signed Contract. Failure to comply may result in additional guest/s being turned away and/or the entire party may be subject to eviction at their own expenses.

Behavior and Client responsibility

The clients are responsible for the actions of the members of their traveling party. They all must act responsibly and with respect towards neighbors, the property owners, their staff and the property itself at all times. They all must respect the Greek law and comply with all statutes, ordinances and requirements of all municipal and state authorities now in force, or which may become in force, pertaining to the vacation use of the property. We reserve the discretionary and absolute right, acting in good faith, to require any individual to vacate the property for disruptive behavior, in which case there would be no refund of any rental payment.

Animals

Prior consent of the owner is absolutely necessary to bring your pet with you. If there is no such prior agreement, a pet is found on the premises (or more than agreed), the owner has the right to refuse the rental, cancel immediately the Agreement and withhold the payment. Moreover, costs for any stains or damage caused by a pet will be the responsibility of the Client. Pets are not to be allowed to sit or lay on any furniture or beds and enter the swimming pool. Pet owners must provide proper restraints and enclosures for pets left alone for any period of time on the premises. Pets are not to use any part of the property (interior or exterior) for the purpose of making any bodily discharge. If an accident does occur it is the responsibility of the owner to clean up any waste and dispose of it properly. Potentially aggressive and unfriendly pets must be guarded at all the times in order to allow our staff on duty to access safely the property. Villas that accept pets may ask for an increased Security Deposit and a pet keeping fee.

Swimming pool

Clients avail themselves of the pool and pool area at their own risk. Lifeguards are not provided. Under age members of the party must be surveilled by and are responsibility of elder members. Inflatable floating devices may be used in the pool, they must be removed from the water when unused or when the pool is left unattended (e.g. at night) in order to let the filtering system work properly.

Cash Security Deposit

A Security Deposit in cash Euro specified in the Contract is payable upon check-in at the property. The Client is responsible to maintain and leave the property in the same condition of cleanliness and repair as upon check-in at the arrival and remove all trash to the nearest town trash and recycling receptacle. Any loss and damage to the property, its fixtures or fittings, and excessive cleanings will be charged to the Client and deducted from the Security Deposit. Client is further responsible for any damages exceeding the Security Deposit. Prior to departure, the Client together with the owners will visit the property in order to verify its conditions.

Arrival and departure times

Clients should arrive between 2:00 pm and 7:00 pm on the day of arrival and vacate the property by 10:00 am on the day of departure. If you require special arrival/departure times, please contact Elysian Villas ahead of time and we will try to arrange for the changes. Half of day rental will be charged (departure by 2:00 pm) and full day (departure after 5:00 pm) according to the current price catalogue, without any discounts that may have applied before.

Complaints

Upon arrival the Client must inspect the property and report any concerns. Failure to report a problem or condition during rental constitutes Client’s acceptance of the circumstance and negates any claim thereafter. Should any problem occur with the property, the Client must immediately (within 24 hours) notify the property owner or manager. The Client should also inform Elysian Villas of the problem within 48 hours if the problem has not been remedied. The Client should allow the owner or manager reasonable time to remedy the problem. Vacating the property without Elysian Villas authorization does not constitute an adequate cause for a refund. The Client is responsible for informing Elysian Villas of any complaint and allowing it a reasonable opportunity to remedy the problem during the rental period; failure to do so will void any claim following the rental period.

Liability

Client acknowledges that Elysian Villas does not own any rental accommodations and undertakes only to act as agent for the owner of the property. As such, Elysian Villas shall not be responsible or liable for any accident, loss, damage, injury, or inconvenience arising from the rental. All claims of accident, loss, damage, injury or inconvenience are acknowledged to be solely between the Client and owner. Elysian Villas does not accept liability for any loss or damage caused by weather conditions, riot, strikes, sickness, acts of terrorism or any other cause.

Promotional Information

Elysian Villas has taken care to ensure the accuracy of all information and descriptions contained in its website and promotional material at the time prepared, however, nothing in those materials shall be treated as a term or condition of this contract. Elysian Villas shall not be liable with regard to any difference of opinion as to the condition or quality of the properties, or the surrounding area, nor for temporary defects or stoppages of any utilities. Properties may not always appear exactly as pictured or described due to normal wear and tear, changes in furnishings and changes after materials were prepared.

Notice

Owners or managers reserve the right to enter the property for inspection at all times with reasonable warning/notice to renter. The Client is not allowed to change the setting or decoration of the houses (including furniture placement) without the prior consent of the Owners. Re-arranging the houses can lead to cancellation of the booking and forfeiture of the whole stay and damage deposit amount. Rental price includes for all properties cleaning, change of linen and towels as otherwise agreed/stated. Rental price does NOT include any transfers (person or luggage) to or from the property, tolls, gas/petrol, car rental or ferry ticket back and forth to an island. Rental price does not include any other form transportation or transfer (port, airport, taxi, other).

Travel insurance

Clients are strongly advised by Elysian Villas to protect their investment by purchasing some kind of Travel Insurance. Available separately from an insurance company, Travel Insurance protects Clients from financial loss before and during a trip for cancellations that occur for a covered reason.

Acceptance

The Client making the booking and all members of the traveling party agree to accept and abide by the Terms and Conditions of this Contract.
